The firm carries out its activities as well in the field of the council as in that of the litigation.

The litigation practice includes

  • Proceeding’s preparation (choice, establishment of special proceedings such as infringement seizure, cooperation with Customs)
  • Choice, organisation and the follow-up of proceedings (civil, commercial, penal)

The Firm intervenes therefore before all French and European jurisdictions and administrations specialised in Intellectual Property, such as :

  • All French jurisdictions
  • French Institute of Intellectual Property law (INPI)
  • French Commission of employee’s inventions (CNIS)
  • Trademarks and Designs registration Office of the European Union (EUIPO)
  • The General Court of the European Union (EGC)
  • Court of Justice of the European Union (CJEU)
  • Internet Corporation for Assigned Names and Numbers (ICANN)

The legal advice practice includes notably

  • The drafting of agreements (confidentiality agreement, license agreement, sales contracts, agreement of co-existence, negotiations, settlement agreement ...)
  • Strategy consulting protection and defence of intellectual property rights
  • Due diligence
  • Internal training on-site (update, various training …)
For example, the Firm appealed to the General Court of the European Community to obtain the filing of a three-dimensional trademark, on the shape of one famous bottle of water (Contrex mineral water), which was refused by the Community Trademark Office.

Recently, and after the winning of the case in trademark infringement, the Firm pleaded to the European Court of Justice, about the difficulty of enforcing a decision of the European Court in each European Union member. The Court deemed that the scope of the prohibition against further infringement or threatened infringement of a Community trade mark, issued by a Community trade mark Court whose jurisdiction is based on Articles 93(1) to (4) and 94(1) of that regulation, extended, as a rule, to the entire area of the European Union (Webshipping case).
